Consumer Protection & Class Action

Williams Cuker Berezofsky has brought many state and national consumer class action cases on behalf of consumers who are fighting back against a wide array of abusive sales and lending practices. We have successfully challenged violations of state usury and consumer fraud statutes, and established precedents expanding the rights of home buyers and prohibiting businesses from using mandatory arbitration clauses to contract out of liability under the consumer protection laws.

Through its consumer class action litigation, Williams Cuker Berezofsky has vindicated or is now fighting for consumers’ rights by:

  • Successfully challenging Rent-A-Center’s exorbitant interest charges on “rent-to-own” installment sales of household furniture and appliances in a case that was litigated to the New Jersey Supreme Court and resulted in a $109 million settlement for New Jersey consumers;
  • Requiring home sellers to disclose to buyers the fact that a home is located in close proximity to a solid waste landfill, in a case that resulted in a multi- million dollar settlement for home buyers in a residential development;
  • Suing banks and other purveyors of “payday loans” that gouge low-income people by charging them interest rates in excess of 500% APR for short-term loans;
  • Challenging Chase Bank USA’s practice of retroactively increasing interest rates on already-incurred credit card balances;
  • Challenging Comcast’s practice of charging cable television customers monthly rental fees for converter box equipment that they do not need for basic and advanced basic cable service;
  • Suing The Coca-Cola Company for fraudulently marketing its soft drink Enviga© to consumers as a “Calorie Burner” weight-loss product when there is no scientific support for its advertising claims.
