Veteran Wins Remand of Agent Orange Benefits Claim Jasper Lassiter served in the U.S. Army in Viet Nam from January, 1969 to May, 1970. He was exposed to Agent Orange at an ammunition dump in Can Ranh Bay, and developed dyshidosia, a severe skin disorder. the VA denied his claim twice in the 1990's, and in 2006 its regional office refused to reopen his claim, despite new evidence he offered in testimony. Mr. Lassiter retained Williams Cuker Berezofsky and our co-counsel, Stephen S. Pennington and Jamie C. Ray. On April 5, 2010, the U.S. Court of Appeals for Veterans Claims vacated the Board's decision, and remanded Lassiter's claim for readjudication! The Court reminded the Board that "a remand is meant to entail a critical examination of the justification for [a] decision," and ordered it to "proceed expeditiously". WCB's Beth Cole, along with Pennington and Ray will continue to represent Mr. Lassiter as his claim moves forward. |
