 I try to run one marathon every year, somewhere in the world.  Long distance running requires discipline, perseverance and a commitment to completing a challenge taken on. Esther Berezofsky is nationally recognized and respected for representing plaintiffs in complex litigation involving mass torts, pharmaceutical drugs and medical device products liability, consumer fraud class actions, environmental litigation and chemical exposure cases.  As one of the foremost environmental attorneys in the country, she has litigated high-profile cases including– notably as lead counsel the Toms River case–which has been profiled in books, television news programs and other media.

Toms River involved a community in which contaminated drinking water caused children to develop cancer at alarming rates thus its designation as a cancer cluster. Williams Cuker Berezofsky, through its investigation and work with scientific experts, was able to bring resolution to the affected families.

Ms. Berezofsky is regarded as one of the leading mass tort pharmaceutical and medical device attorneys in the country. Recent matters include representing those injured by defective devices manufactured by DePuy and Stryker, and insulin pumps and pain pumps manufactured by Medtronic. She is currently representing plaintiffs in pharmaceutical product liability matters including the drugs Benicar, Rezulin, and Paxil among others.

Ms. Berezofsky is also a lead negotiator in many of the firm’s complex cases; she has been appointed Lead and Liaison Counsel in various state court litigations.

Ms. Berezofsky served as President of Public Justice, a national public interest law firm, during the 2014-2015 term.  At the conclusion of her service, she was awarded a bronze statue in appreciation for her “warrior-like determination” to advance the cause of justice for the organization’s initiatives. She continues to serve on the Executive Committee of the Board of Directors.

She is on the Board of Governors of the New Jersey Association for Justice (NJAJ) and was awarded its New Jersey (ATLA-NJ) Gold Medal for Distinguished Service. Ms. Berezofsky is also an officer of the Section on Toxic Environmental and Pharmaceutical Litigation (STEP) of the American Association for Justice (AAJ). She has been honored as a New Jersey Super Lawyer annually from 2007-2017 for class action/mass torts, consumer law and environmental litigation.

  • In re Toms River Cancer Cluster: Successfully represented families with childhood cancer in community in which chemicals contaminated the drinking water.
  • Barton v. Wyeth: Represented plaintiff who developed breast cancer from hormone drugs resulting in jury verdict of $78M, including $75M in punitive damages.
  • Singleton v. Wyeth, Inc.: Represented plaintiff whose breast cancer was caused by Wyeth’s hormone-replacement therapy (“HRT”) drugs, resulted in $3.45 million compensatory damages and $6 million punitive damages awards.
  • Magistrini v. One Hour Martinizing, et al.: Published decision re defendants duty to warn in toxic tort case.
  • Brigman v. Wyeth: Diet Drug Litigation resulting in published decision re: heeding presumption and learned intermediary. 


Ms. Berezofsky is featured in the media, highlighting both her litigation successes and knowledgeable commentary on legal issues. She has authored articles and book chapters, and presents frequently at conferences, continuing legal education seminars and other events.

Featured author: Ms. Berezofsky authored the chapter “Environmental Torts” in the 2015 New Jersey Mass Tort & Class Action Treatise, a valued resource for legal practitioners. The Treatise is published by the New Jersey Association for Justice. More than 50 attorneys and judges, experts in their respective fields of practice, contributed to the work.
